These terms of use apply exclusively to your access to, and use of, CFTC data submission
systems and do not alter in any way the terms or conditions of any other agreement
you may have with the Cftc.
These terms of use may be changed at any time without notice by the Cftc.
If any provision of these terms of use shall be deemed unlawful, void, or for any
reason unenforceable, then that provision shall be deemed severable from these terms
of use and shall not affect the validity and enforceability of any remaining provisions.
User ID and Password
A unique User ID and Password will be generated by the CFTC and emailed to the
email address you provide.
- You agree to notify the CFTC immediately if you have reason to believe your password
has been lost or stolen; your account has been accessed improperly; or attempts
have been made to access your account without your permission.
- Only one individual or entity can use each User ID and Password. Accounts
are non-transferable.
- User IDs and Passwords may be used only to submit valid data and may not be used
for any fraudulent purposes.
- The CFTC reserves the right to reset any Passwords that have been lost or stolen
or have not been used for more than 120 days.
Privacy Act Disclosure
Our legal right to ask for information from traders with large futures or option
market positions is granted in sections 4i and 8 of the Commodity Exchange Act (7
U.S.C. 6i and 12). Disclosure of the information called for is mandatory and failure
to comply may result in the imposition of criminal or administrative sanctions (see
e.g., 7 U.S.C. 9, 213a-1, 13(c)).
The information requested is used generally in the Commission’s market surveillance
activities to provide information concerning the size and composition of the commodity
futures or option markets, and to permit the Commission to monitor and enforce the
speculative position limits that have been established. The complete listing of
routine uses, in accordance with the Privacy Act, 5 U.S.C. §522a, and the Commission’s
rules thereunder, 17 CFR Part 146, of the information contained in these records
is found in the Commission’s annual notice of its system of records.
Data from the forms may be used by the Commission in the conduct of investigations
or litigation and, in limited circumstances, may be made public in accordance with
provisions of the Commodity Exchange Act. It may also be disclosed to other government
agencies and to contract markets to meet their responsibilities assigned to them
by law.
